Terms of Service

1. Acceptance and scope

By creating an account or using Taggix (the “Service”), you agree to these Terms of Service, our Privacy Policy, and any supplemental terms that apply to specific features (such as terms for Pro photographers). If you do not agree, do not use the Service.

2. Definitions

“Operator” means the person who provides Taggix, identified in the Operator details above.

“Service” means the Taggix website, applications, and related features.

“User” means anyone who creates an account or uses the Service.

“Participant” means a User who discovers and reviews photos in which they appear.

“Photographer” or “Pro” means a User accredited to upload event media and offer their services.

“Content” means photos and any other material uploaded to or generated through the Service.

“Universal Tag” means the persistent identity token Taggix assigns to a Participant across events.

“Credits” means the in-app units used to access certain features; Credits have no monetary value.

“Match” means a system-suggested association between a photo and a Participant based on detected identifiers.

3. Eligibility and age

You must be at least 16 years old, or the minimum age of digital consent in your country if higher, to use the Service. The Service is not directed to children below that age. By using Taggix you confirm you meet this requirement.

4. Your account

You are responsible for the accuracy of the information you provide, for safeguarding your credentials, and for all activity under your account. Keep your password secure and notify the Operator promptly of any unauthorized use.

5. What the Service is

Taggix helps Participants discover photos of themselves from events. Photographers upload event media; the Service detects identifiers in images using optical character recognition (for example, bib or sail numbers) and AprilTag detection, and suggests Matches to Participants, who review and confirm them.

Matching is based on these identifiers and tags. Taggix does not perform facial recognition and does not use faces as biometric identifiers. Matching is automated and may be incomplete or contain errors.

6. Your content and your responsibilities

You are solely responsible for the Content you upload and for how you use the Service. You represent and warrant that you have all rights necessary to upload your Content and that it does not infringe the rights of others, including the image, privacy, and personal-data rights of people depicted.

You must comply with the prohibited content and conduct rules in Section 11. The Operator does not pre-screen Content and is not responsible for User Content or User conduct.

7. Licence you grant

You retain ownership of your Content. You grant the Operator a worldwide, royalty-free, non-exclusive licence to host, store, process, watermark, analyze (including OCR and tag detection), and deliver your Content to matched Participants in order to operate the Service, and to use your Content to promote Taggix itself (for example on our website, social channels, and advertising).

This licence is non-sublicensable, except to service providers acting on our behalf to run the Service and as set out in the following paragraph, and does not include selling or sublicensing your Content to third parties for their own purposes. The licence ends when you delete the Content or close your account, except for copies retained as required by law or already delivered to matched Participants.

Participant sharing: to enable Participants to share the photos they appear in, you also grant the Operator the right to sublicense to a Participant matched to your Content a limited, non-exclusive, revocable, non-commercial right to publish and share the low-resolution watermarked version of that Content on social networks and messaging services. This sublicence covers only the low-resolution watermarked version and never the original or clean file. It ends when the Participant stops sharing, when the Content is removed, or when your account is closed. You can disable Participant sharing for any event from that event's settings.

8. Photographs of other people

Event photography often depicts people who are not Users. You are responsible for ensuring you have the right to photograph and upload images of others in the relevant context.

Any person depicted in a photo — whether or not they have a Taggix account — may request removal of that photo or object to its processing by contacting the Operator (see the Privacy Policy). The Operator will act on valid requests as required by applicable law.

9. Pro photographers and commercial use

Accredited Pro photographers may upload event media and make their professional contact available to interested Participants. When a Participant unlocks a Pro’s contact, they may reach out directly; any resulting transaction or engagement is solely between the Participant and the Pro.

The Operator is not a party to, and is not responsible for, any agreement, service, payment, or dispute between Participants and Pros. Pros must comply with these Terms and any supplemental Pro terms.

10. Credits and in-app economy

Certain features use Credits. Credits are an in-app convenience with no monetary value; they are not money, cannot be exchanged for cash, and are non-transferable and non-refundable except where required by law.

Credits may be granted, earned, or adjusted by the Operator, and the cost of features may change. Taggix does not currently offer the purchase of Credits with real money; if paid Credits are introduced, additional purchase terms will apply.

11. Prohibited content and conduct

You may not upload, share, or use the Service for any of the following:

Sexual or pornographic content, nudity, or sexually suggestive material. There is zero tolerance for any sexual content involving minors: such content is removed immediately, the account terminated, and reported to law enforcement and competent authorities.

Any unlawful content or activity under applicable law.

Hate speech, harassment, threats, discrimination, or incitement to violence.

Violent, graphic, gory, or shocking content.

Political campaigning, propaganda, or election-related content; Taggix is for sports and event photography.

Extremism, terrorism, or content promoting self-harm.

Content that infringes intellectual-property rights, or that violates others’ privacy, including images you have no right to upload and the doxxing of others.

Deceptive, fraudulent, spam, or malicious content, including malware and phishing.

Content unrelated to the events and sports purpose of the Service.

Prohibited conduct includes scraping, reverse-engineering, probing or circumventing security, impersonation, defeating watermarks or the Credits system, and abusive multi-account behavior.

The Operator may remove Content, suspend or terminate accounts, preserve evidence, and report to authorities at its discretion. You remain solely responsible for your Content and conduct and indemnify the Operator as set out in Sections 6, 8, 14, and 17.

12. Intellectual property

The Taggix name, logo, software, and all related intellectual property are owned by the Operator or its licensors and are protected by law. These Terms do not grant you any right to use Taggix’s trademarks or software except as necessary to use the Service. Your Content remains yours, subject to the licence in Section 7.

13. Copyright and IP infringement complaints

If you believe Content on the Service infringes your copyright or other intellectual-property rights, send a notice to the Operator’s designated contact identifying the work, the infringing material and its location, your contact details, and a statement of good-faith belief.

The Operator will review valid notices, may remove the material, and operates a repeat-infringer policy under which accounts that repeatedly infringe may be terminated.

14. Content moderation, reporting, and enforcement

Any User — including a Participant matched to a photo — can report Content they believe is illegal or violates these Terms (the categories in Section 11).

A report must include a valid, good-faith reason: a selected category and detail. Reports submitted without a valid reason are a misuse of the Service.

On a report, the Content is flagged and may be placed under review, and the uploader may be restricted or placed under review pending the outcome.

The Operator reviews reports and may remove Content, suspend or terminate the uploader, preserve evidence, and report to authorities.

Both the reporter and the affected uploader receive notice of the outcome with a statement of reasons and a way to contest the decision.

If three or more of a User’s reports against the same uploader are determined on review to be baseless or in bad faith, that User’s account may be automatically suspended or terminated. This count is based on baseless determinations, not the number of reports submitted.

15. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. We do not warrant that Matching is complete, accurate, or error-free, or that the Service will be uninterrupted or secure.

16. Limitation of liability

To the maximum extent permitted by law, the Operator is not liable for indirect, incidental, special, or consequential damages, or for lost data or profits. The Operator’s total liability for any claim is limited to the amounts you paid for the Service in the 12 months before the claim, or, where you paid nothing, to the extent permitted by law.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for gross negligence, willful misconduct, death or personal injury caused by negligence, or your statutory consumer rights.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold the Operator harmless from claims, damages, and costs arising out of your Content, your use of the Service, or your breach of these Terms or of the rights of any third party.

18. Suspension and termination

You may stop using the Service and close your account at any time. The Operator may suspend or terminate your access for violations of these Terms, to comply with law, or to protect the Service or its users.

On termination, your licence to use the Service ends; the handling of your Content and Credits is described in Sections 7 and 10 and in the Privacy Policy.

19. Changes to the Service and to these Terms

The Operator may modify or discontinue features of the Service. We may also update these Terms; for material changes, we will require you to accept the updated version before continuing to use the Service.

20. Governing law and jurisdiction

These Terms are governed by the laws of Italy, without prejudice to the mandatory consumer-protection rules of your country of residence. The courts of Trieste, Italy shall have jurisdiction over any dispute arising out of or relating to these Terms. If you are a consumer, you may also bring proceedings in the courts of your place of residence where the law so provides.

21. Dispute resolution

If you have a problem, please contact the Operator first so we can try to resolve it informally. If you are an EU consumer, you may also use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Nothing here limits your right to bring a claim before the competent courts.

22. Miscellaneous and contact

These Terms, together with the Privacy Policy and any supplemental terms, are the entire agreement between you and the Operator regarding the Service. If any provision is found unenforceable, the remaining provisions stay in effect.

You may not assign these Terms without the Operator’s consent; the Operator may assign them in connection with a reorganization or transfer of the Service. The Operator’s failure to enforce a provision is not a waiver. Neither party is liable for delays caused by events beyond its reasonable control.
